Statute of limitations to file a public entity claim is 6 months. In some instances you can file a late claim. Contact an attorney ASAP.

Legally you are entitled to recover damages once. I am certain there is a reimbursement clause in your policy.

Yes they send a 1099 but you will not need to pay taxes. Talk to your accountant or CPA. It is considered compensation and not income.
