Neighbor sued neighber under the Homeowners' Assocaiiton CCR's for construction of alleged unlawful wall obstructing neighbor's protected view. In representing the defendant neighbor, I filed a motion ... for summary judgment in favor of plaintff. Plaintff refused to accept victory and uncessessfully attempted to amend the complaint to continue the litigation. The judge denied plaintiff's motion to amend the complaint and awarded attorneys fees to our client The court of appeals affimed the lower court's ruling that our client was the prevailing party and also entitled to attorneys fees.
