If they don't prove your BAC was over the legal limit, the generally do not require an SR 22. I would recommend calling the DMV's Mandatory Actions...

In California you do have the ability to expunge (dismiss) the criminal charges. However it remain on your DMV record much longer.

Unfortunately the law is pretty clear: if you not raise the issue at trial, you are denied the right to bring it up on appeal.
