Yes. If your and his insurance didn't cover the damage, you can sue him for the difference. Small claims, California limit is $10,000

It sounds like abandonment to me. If you give up the dog, she owes you for food, etc.

If the prosecutor believes that the perp did the crime, but doesn't have enough evidence, it is an economic/practical decision, not an ethics...
