OUTCOME: We prevailed at trial court and at the Bankruptcy Appellate Panel on behalf of Carla Cohen.

Debtor Scott Cohen objected to his wife Carla Cohen continuing to prosecute her family law proceeding during a Chapter 7, alleging that she needed to file a non-dischargeability complaint to determine ... whether or not her claims under 11 U.S.C. Sec. 523(a)(15) were discharged. We argued that as a result of the BAPCPA amendments to the bankruptcy code, such complaints were no longer necessary as Congress had excepted these types of claims from the requirement of filing a complaint within any specific time period.

We sued a creditor for a Discharge Violation under 11 U.S.C. Sec. 524. Interpreting IN Re: ZILOG the Trial Court determined on the facts that the Creditor had no intent to violate the discharge injunc ... tion. We overturned the Judge's review of the facts with the Bankruptcy Appellate Panel.

OUTCOME: 9th Circuit District Court of Appeals Affirmed the District Court and Reversed and Remanded the matter back to the Trial Court for a ruling consistent with their opinion.

Individual realtor requested the right to avoid a non-possessory non-purchase money lien on her vehicle as a tool of the trade pursuant to 11 U.S.C. 522(f). Trial Judge stated that this was not possib ... le and that the use of the wildcard exemption for this purpose was impermissible. District Court Reversed and Remanded.

This is an appeal from the U.S. Bankruptcy Court we took from the trial court's ruling that 11 U.S.C. 522(f) could not be used to avoid a non-possessory, non-purchase money security interest in persona ... l property as a tool of the trade. Specifically, the court felt that a Realtor could not claim her vehicle as a "tool of the trade." We represented the realtor.
