if taxes were required and the sponsor didn't file this should be remedied before responding to USCIS either by filing or requesting an extension....
My husband never filed income tax returns. USCIS asks for explanation why you are not required to file.

If he came with a visa he can apply for Form I-102 for a replacement I-94 card.
