Appeals Court ordered the trial court to dismiss the case with prejudice on double jeopardy grounds because it granted the prosecution a mistrial over my objections. Client accused of physically injur ... ing his 2-month old baby; other evidence demonstrated that another had caused the injury. Court granted the state a mistrial over objection when our confession expert testified that statements by the client given to an interrogator were coerced. The statements did not even hurt the client since he maintained that he had not injured his baby. Occasionally and only reluctantly during the 3 hours of interrogation would the client agree that it was possible perhaps that the injury scenarios offered by the interrogator could maybe have happened, but often he would then say, "but I don't think so." Jurors laughed during my cross-examination of the interrogator because he could not identify where my client said anything close to "I did it."
