No. It means that at some point the court will dismiss the case and the parties will have to start all over again.

The date of separation means that any debts acquired after that date, would not be your responsibility.

He needs to file for divorce in his first marriage and he can do it here. Also, note that there is no such thing as common law marriage here in CA...
