Despite Mr. Sabado’s efforts, the judge denied the motion. Mr. Sabado was forced to go to trial without the benefit of the information from the two police officers’ personnel records. Consequently, the client was found guilty based upon the officers’ trumped up accusations. However, after trial the case was appealed. On appeal the Appellate Court unanimously agreed that Mr. Sabado’s Pitchess motion was properly written and the judge should have granted Mr. Sabado’s motion.
