    Description:
    Mr. Sabado filed a Pitchess motion on behalf of his client before trial. A Pitchess motion is designed to convince a judge that there is good cause to look into a police officer’s private personnel records to search for other instances of police misconduct because it is plausible that the officer committed misconduct in the investigation of this case. Despite Mr. Sabado’s efforts, the judge denied the motion. Mr. Sabado was forced to go to trial without the benefit of the information from the two police officers’ personnel records. Consequently, the client was found guilty based upon the officers’ trumped up accusations. However, after trial the case was appealed. On appeal the Appellate Court unanimously agreed that Mr. Sabado’s Pitchess motion was properly written and the judge should have granted Mr. Sabado’s motion. The conviction was overturned, the client was granted a new trial, and the judge was ordered to grant Mr. Sabado’s original request. See 2012 Cal. App. Unpub. LEXIS 979
