Custody -Move Away (Abduction)
N/AOUTCOME: The departing parent received custody with the California parent's rights of visitation during summer and school vacations.
There was unreported domestic violence and one party left California to join family in another state and took the minor child without consent and knowledge of the other party. The abused parent never ... filed anything anywhere and the left behind parent filed for child abduction, sole custody in California. We represented the parent who left California (departing parent) with the minor child. The departing parent had two prior attorneys before being directed to our office because orders were for the minor child traveling back and forth twice every month between two states and the minor became very ill from back and forth travels from east to west and vice versa. We set the matter for trial. The custody evaluator prepared a report to assist the court with rendering an Order and the evaluator recommended for the California parent to have custody with visitation to departing parent. At trial, after presenting evidence, showing bias and mistakes by the custody evaluator, Court did not accept the evaluator's recommendation!
