OUTCOME: DMV appeal hearing of ruling on "Lack of Skill" matter successful!

Won a DMV "Lack of Skill" hearing earlier this week where my client was pulled over for a minor traffic infraction (which was disputed) and then the Officer subsequently informed the DMV that they shou ... ld take away her driver license even though she had no traffic accidents or violations in over 10 years. It appeared to me that this action was taken against my client based on her age, not "Lack of Skill" issue. She then took a driver license test and did not pass, with the instructor stating that she should not be able to take another driving test and her license revoked permanently. Although the driving test evaluator did state several reasons why she did not pass, there was nothing egregious in there, no "almost caused accident" issue or anything of that nature. Again, seemed to me to be a harsh ruling based on age, not a "lack of skill" issue. After an appeal of the indefinite license suspension I was able to get that ruling overturned and get her another driving test (once DMV reopens) with a temporary permit to drive and prepare for the drive test.

OUTCOME: Warrant recalled, Charge completely dismissed!

Client had an outstanding warrant on an otherwise minor charge for littering. Along with a fine, a littering conviction requires mandatory community service hours ordered by the Court, which means tha ... t unlike some other infractions, this citation includes a mandatory court appearance. The client needed to fly two days after contacting me on this matter and needed the warrant cleared immediately. Normally that would not be very complicated, but based on Covid-19 Court/dept closures and clerk windows being closed at the courts, it made the task much more challenging. Knowing how important this was to my client, I spent over four (4) hours immediately after being retained attempting to get the case added to the Court calendar, and was ultimately successful after getting approval from the Court supervisor. Then next challenge was when I arrived at Court for the Hearing, the Court doors were locked, the case was not on calendar, and they were not letting people into the Court house. After several calls to the Dept where the hearing was to take place in, and again getting the supervisor involved, I was able to gain entry into the Court. The final hurdle was dealing with the Warrant and the underlying charge. I was successful that day in getting the warrant recalled and quashed. And better yet, based on the formal written motion I provided to the Court at the hearing, the Judge dismissed the ticket completely!

OUTCOME: All three cases, charges reduced from felony convictions down to Misdemeanors

Client had previous drug related felony convictions for H&S 11359 and 11360. There were three separate cases total (each with one conviction). They were older convictions that he already had dismisse ... d (ie. expunged) a few years earlier. I was successful getting all three convictions reduced to misdemeanors, so they were misdemeanors for all purposes that were dismissed (ie. expunged) as opposed to felonies, which was advantageous for him for several reasons, including international travel.
