You might already have a failure to appear for not dealing with your citation timely. Check with clerk at courthouse. Bring proof.

The stop would only needed to be challenged if other significant charges were made afterwards. You have not indicated any.

Both of my colleagues responses are correct. The key is whether he qualifies under Prop 47 to get felonies reduced to misdemeanors.

Clerical errors will not get tickets dismissed . You might want to get an attorney to fight this as you could be required to do community service...
Do you have a right to a copy of police report if you are the one charged and currently do not have an attorney??

The only place you can get one is at arraignment - not sooner.
