You need an attorney to deal with this . It is up to judge- but DA can certainly object.

This could be dealt with by military and In federal court. Speak with a military attorney.
What does sentence status 3 mean (on a visiting pass)? Why isn't his SP status updated on the Sheriffs web site?

I believe it is too early to file for expungement. Typically you have to pay all fines and complete class- and wait out at least one year or more.
