You need an attorney to file a motion to suppress the evidence. This is a tough motion.

Unfortunately you need to set this matter for arraignment and then trial to speak to officer. It is the officer who must agree to a non point...

For felony Grand Theft does the prosecution have to show that the defendant had possession of the stolen items.

More facts are needed. Possession can be shown other ways. You still an auto or rob a bank and give items to another.

I have never seen ICE in court for any infraction. Get an attorney to deal with this. An attorney can appear for you.

Unless there is a court order nothing can prevent him from moving out of state. If he fails to show for trial there will be consequences.
