My client is the sole heir to her father's estate consisting of a house. At the time of filing the probate petition, the last deed recorded was in the name of the decedent. However, two months later I ... discovered that another deed had just been recorded. Apparently, one year before her dad passed, he signed a transfer deed to 2 other people as well as to my client but it was never recorded. My client did not know who these other 2 people were. Due to the fact that litigation would be too costly & time-consuming, we settled the case allowing the court to issue an order placing the entire interest of the house into the estate.
