Shopper vs. Large Retail Store

OUTCOME: Trial Victory $100,000

In this premises liability and negligence case, Client was shopping for a TV at Costco. She was standing in front of a display of large TV's. A store employee was showing an adjacent TV to another set ... of shoppers and while handling the TV, knocked another TV on to Client's shoulder and arm. Client's shoulder required surgery. This case was won at trial. I was co-counsel in the case with my father Barry Regar. The employee who caused the accident didn't take responsibility and changed her testimony when I cross-examined her during trial. The jury believed that Costco should have taken better care to prevent heavy TV's from falling on their patrons.

This case arose out of a motor vehicle accident where my clients (a mother) and her two daughters were hit by a negligent driver. Mother and daughters sustained soft tissue injuries and remained sy ... mptomatic for several months. The mother had to miss some work and the daughters had to miss school due the pain they were in after the accident. Fortunately, the daughters were young and otherwise healthy and they made a good recovery. The mother also felt better after a period of time. Each one of the clients went to physical therapy which they found to be a big help in their rehabilitation from the accident.

Bicyclist vs. Defendant Driver

OUTCOME: Settled at mediation for $125,000

Our client was riding his bicycle at night across a highway when he was struck by a negligent driver and seriously injured. Our client was under the influence of alcohol, and he did not have a light on ... his bicycle. The intersection was illuminated by two streetlights. We chose to represent this accident-victim because the defendant driver was driving irresponsibly. Prior to being struck, our client had crossed 90% of the highway and the defendant driver had ample time to see him on his bicycle. In fact, the defendant driver's own passenger saw our client before the impact--so did the driver of an adjacent car and a car that was trailing the defendant's car. The defendant driver was simply not keeping a proper look-out.

Client, in her third trimester of pregnancy, was rear-ended while stopped at an intersection. She went into preterm labor. Her doctors gave her drugs to stop the contractions. She was then at risk of d ... elivering early. The negligent driver was uninsured. Plaintiff is seeking recovery from her uninsured motorist coverage.
