Accident happened on August 29, 2003, Eastbound on I-40 freeway near Milepost 106.9 outside Seligman in the County of Yavapai, Arizona. Plaintiff Ashlea Biggs was 12 years old at time of accident. Plai ... ntiff filed suit in November 2010 (within the statute of limitations) after Plaintiff reached the age of majority. Plaintiff was a passenger in the back seat of a vehicle driven by defendant on a long road trip when defendant driver lost control of the vehicle causing it to roll over. Plaintiff was unrelated to the the driver or the other two people in the car, which was a family that was friends with Plaintiff's family. Plaintiff claimed defendant driver fell asleep at the wheel and defendant driver claimed a third vehicle (a truck) struck them causing the accident. Plaintiff was ejected from vehicle and suffered serious injuries. Plaintiff was airlifted to Flagstaff Medical Center in Arizona. Plaintiff suffered a closed head injury, an acute head injury, a broken ankle and other injuries. Insurance companies originally offered $35,000 for full settlement. The X-Law Group settled the matter on July 28, 2011 when the matter was settled for policy limits of $115,000.
