So it seems you are a US citizen? If so, yes you can marry with a joint sponsor and apply for Adjustment.

If he h-1 was properly filed while you were still a valid h-4 - which we do not know - then maybe. If the h-1 is denied you cannot go back to h-4,...

You can marry in the US but his immigration processing will take place out of the US. This is complicated. See a local attorney to process.
