So you have an H-1B from an old employer valid to March 2013. If you are still working with the old employer and still in status, you might be OK....

Yes - H-4 is based on H-1B. It must have been an error. Do not let her travel until you have your status approved.

You can renew but at that point they look to see if you are removable or not. And that is based on the conviction and not necessarily the jail time.
