Now that obama passes that policy last friday and am I eligible when can I apply and what can I do thanks to this policy ?

I think the Embassy said that because he was unlawfully present here before he took the voluntary departure. They are two different things.

If you have a student visa in your passport and you have valid student documents, perhaps you can leave. Too many unknowns to be sure.

My L1 visa is expired May 2012; I have a valid I-94 till 2015. Can my org file L2 on expired L1 with valid I-94 for my spouse?

OK - you are still legally here and so you can ask for an L-2. Yes - the L-2 is eligible for an EAD.
