You can petition him but he will have to wait ten years or so. His wife is his best avenue.

It is a crime of moral turpitude but it should fall into a category of a petty crime and so should not count.

If you are in court you do not want to file a wom. You need a competent attorney to get you a work permit and ID so you can get joint documents.
