Under current CA law a DUI leaves my record after 10 years. But may I get it dismissed before then? Do I need an atty to do so?

Regardless of what happens, you do not want another DUI or you will have enhanced penalties.

As long as you have a license, you can drive legally, I hope a lawyer is representing you. Do not represent yourself.

I do not believe you have grounds to sue the DMV. You are entitled to an appeal or writ if the time has not passed to do so.
