In most states you do not need the consent of the other spouse to get a divorce. I would check with a lawyer, but you probably do not need anything...

If you file a small claims case, it will be heard. I am not sure what you mean by "will it be passed over?"

Yes! However, there are there are other requirements so have the lawyer also ensure that the will is valid under your state law.
