Yes, she could, but she must understand that she cannot work in the US unless and until she is in valid H-1B status.

It will take many years. You will NOT need to refile if he marries, but his petition will convert to 3d preference with an attendant longer wait.

You can submit the RFE with incomplete evidence and the USCIS could deny the petition on that basis. Consult with an immigration attorney.
