Yes, "cross-chargeability" is possible if a spouse was born in Hong Kong before it reverted to Chinese control.

He is removable from the US for alien smuggling and/or any convictions he suffered. He must appear before an immigration Judge for those proceedings.

The person must be able to show income meeting the required level, so bankruptcy very well could be a problem. Consult with an immigration attorney.

US Passport is conclusive evidence of US Citizenship for the USCIS. he may have automatically acquired citizenship and not have an actual...
