If you were laid off, your previous employer would probably be committing a fraud by requesting premium processing at this point.

That depends on an analysis of a number of factors. Visa Waiver entrants cannot extend their stay beyond 90 days.

Which is why you should either naturalize or file an I-90, to obtain the current version of the green card,m which is instantly verifiable.

Company C could petition you, but the outcome of Company B's petition will certainly impact the validity of the 3d petition.
