Smart, nice man but use someone else!

My attorney failed to file a lodgments in my case, claiming they were not necessary because OC filed theirs. None of my exhibits were seen by the judge. My attorney failed to file a reply brief in answer to the OC responses. He claimed it wasn't necessary because he was appearing in court to refute t...he responses. Every response was perjury and slander and were allowed to stand. He failed to bring up the contempt by my ex husband by closing 401k account, stock, bank accounts, not paying joint debts and more. With no chance to respond the judge held that I should not have waited 7 years to go back to court. I waited because that is what our settlement agreement set forth, marital estate to be divided upon retirement. I am now forced to go in pro per. Jason is smart, but not prepared for court. He was late to the hearing and was scolded by the judge for telling OC he couldn't object. He continued to pronounce my name incorrectly and presented nothing in my favor. When the judge accused ME of writing all over the court files, he said nothing while I was yelled at. It took the OC to tell the judge that the previous judge made those notations to the file. The judge was so angry with him, he threw the court file across the back of his chair and onto the floor.

This is a fraudulent review. "Kim" hired me to overturn a default judgment that was 7 years old. This was a longshot, but I explained that even though we would likely lose, it was family law, and we could bring a subsequent motion to distribute undisclosed community assets. Winning the longshot motion would have made things procedurally easier, but a loss would still give the court a preview of the second motion. The Court found "Kim" not credible as the record showed she had appeared on the case when it was active (seven years prior), so her claim that she had "no actual knowledge" of the proceeding failed (which was the required element). The court also accepted evidence of her heavy drug use over my objections (which was overruled as such was relevant to her credibility). However, just as I had planned the court invited us to file a motion to distribute undisclosed assets fro the community estate. That never came to be because "Kim" did not pay her invoice and I disengaged. If she ever wants to pay an attorney to handle the second motion, she can still do so because there is no statute of limitations on undivided community assets.
