School bus driver seriously injured when the bus he was driving was struck head on by a person just discharged from the hospital under the influence of narcotic pain medication. The hospital failed to ... warn the patient not to operate a vehicle. The lower trial level court and intermediate appellate court in New York dismissed the case by the bus driver against the hospital. They found that a non patient could not sue for medical malpractice due to a lack of a doctor patient/hospital patient relationship.The Court of Appeals agreed to hear the case and reversed setting a new precedent in New York. This Davis rule is now new law in New York. This is a case that I have litigated and argued in the Court of Appeals.
