OUTCOME: Successfully argued that the foreclosing plaintiff could not proceed until it moved to substituted an indispensable party to the action.

Plaintiff tried to proceed with the foreclose after mortgagor died. Plaintiff did not move to substitute the estate representative for the deceased mortgagor.

Plaintiff bank moved for a default judgment and for an order of reference against defendant homeowner. I argued that the plaintiff failed to move within the requisite time period to seek a default. Pla ... intiff argued that if case is dismissed then it may be barred from filing a new complaint because the statute of limitations would be applicable.
