if you have insurance use it. Anything not covered by your insurance, such as maybe you deductible you can seek out in restitution.

Yes at least have a consultation with an attorney. those percentages can usually be attacked as they are subjective opinions of the doctor.

Probably not. But blackmail is illegal and you can report to the appropriate authorities and if true you may be able to have the settlement set...
