If they are actually waiting for you to do then you have a bad faith action against the insurance carrier. However, I highly doubt that to be true...

Yes you may depose the employee. If the employee has very relevant information then you can subpoena them for deposition.

You can not be paid more than your salary. Temporary disability is 2/3 of the average weekly earnings from the 52 week span prior to your injury....
