Product liability lawsuit against ladder manufacturer arising out of serious personal injury sustained by worker when extension ladder telescoped due to defective rung lock mechanism causing worker to ... fall 20 feet. I also represented the client successfully in his workers' compensation claim which was the genesis of the third party personal injury action. As a result of this lawsuit the manufacturer made significant changes in the design of the rung lock which made the product much safer.

Successfully represented client severely injured in accident at work in both workers' compensation and third party case. In the latter part of the case, successfully defeated summary judgment based on ... statute of limitations by arguing that action was tolled under the doctrine enunciated in the case of Elkins v Derby because the third party closely associated with the employer was on notice of the potential claim by virtue of the workers' compensation claim. Thereafter, the case settled for a substantial six figure sum.
