My client was sued by a former disgruntled manager for violations of the California Labor Code. The manager alleged he was not a manager, and thereby was a non-exempt worker. He claimed that as a non ... -exempt employee he was entitled to standard meal breaks, rest breaks, minimum wages, overtime wages, and other penalties. Though there was ample proof of his performance of duties as a manager, the biggest issue my client faced was proof of this individuals' monthly income, as portions of it were received in the form of alternative compensation. In light of those challenges, we mediated the case, and my client received a satisfactory result.
