I am the first person in my extended family to graduate college. I attended Boston College on a scholarship, graduating in 1972. I attended Harvard Law and graduated in 1975. I was a champion intercollegiate debater and an Ames Moot Court Finalist at Harvard. I pride myself on my writing and oral advocacy skills. However, since 97% of all lawsuits filed in California settle, negotiating skills are just as imortant as courtroom prowess.
I have been AV rated by Martindale(the highest rating for integrity and competence) for approximatley 20 consecutive years and I have been a Superlawyer 6 times.
I work very hard to achieve a just settlement if possible; a result that is prompt and final, a resolution that puts an end to an unfortunate time in the lives of my clients if such is achievable. It takes both sides to conclude a reasonable settlement and if our adversary will not participate in rational negotiations, then I have thecourtroom experience, research and writing skills,and persistence to bring the case to trial and through appeal if necessary.
I am currently representing human rights plaintiffs in the US Supreme Court in the case of Kiobel v. Royal Dutch Petroleum. The questions on review are: 1) whether corporations may be sued for egregious human rights violations under the Alien Tort Statute, and 2) whether the ATS applies to conduct occurring on the soil of foreign sovereigns.
Kiobel will influence greatly the future of human rights litigation and I hope to continue to devote my efforts to the development of the law of human rights.
