You should ask this question of a Hawaiian Attorney laws regarding expungement are different from state to state.

If you already incarcerated and a bench warrant was issued on you due to the fact that you were in jail & missed a court date.

Possibly if the judge knows where you are at, but you should not be punished more because you have a valid reason for missing the court date.
