I doubt it, as such language would probably be sufficient to raise a reasonable doubt in even a prosecutors mind and make this a civil matter.

It is one sided, you can not enforce it against them, but they can sue you. Talk with an attorney in your area.

You can sue in small claims court for up to $10,000 or wait until he is 18 if the decay is even a worse problem then.
