OUTCOME: CASE DISMISSED

Client of ours in Northern was charged with 23 counts of Lewd Acts W/Minor with additional enhanced charges due to multiple acts involving the same alleged victim over a period of time. Bail amount was ... set for $2,300,000 and the xposure for the client was 200+ years in State Prison. At Preliminary Hearing, four of the counts were dismissed and 6 counts amended to lesser attempted charges. At the time of trial, the remaining 19 counts including enhancements were dismissed and our client was released from custody.

Our office was retained by an out-of-state client to appear in a Los Angeles county court to handle a DUI case from 12 years ago. I personally appeared in court and spoke to the prosecutor and related ... problems they will face trying to prosecute such an old case. They disagreed. I then prepared, filed and calendared two motions, a suppression motion (1538.5) and a Serna motion(violations of the right to a speedy trial). On the day of the motions, the prosecutor announced to the court that they were unable to proceed(they couldn't locate the police officers), and the judge had no choice but to dismiss the case.

PC 187 Reduced To Voluntary Manslaughter

OUTCOME: Negotiated a reduced charge of Voluntary Manslaughter with the specially assiged prosecutor with a low 3 year prison term, seven months of custody credits plus good time and work time applied to his prison term.

My client was involved in an argument with an individual. The individual pulled out his gut, pointed it at my client and threatened he was going to shoot my client. My client was able to take the gun a ... way and shot the individual four times with the majority of the shots entering through the individual's back. Prosecutor was offering 13 years in prison and the plea to the PC187. After seven months of litigation, motions and significant amount of discovery, I successfully negotiated a reduced charge of Voluntary Manslaughter with only a 3 year prison term. He had seven months of custody creditsp plus good time and work time applied to his prison term.
