You should request that he pays for the damages to your car. If he refuses, you could file a small claims action against him.

Better bet would be to just get it straightened out and get yourself dismissed from the suit. Consult an attorney in NJ to know for sure.

Sounds like an assault and battery. Report it to the police. You could sue over it too but, collecting on the judgment will be tough.
