It is always difficult to collect from a defendant who is not being honorable. If you can serve them, then you can hopefully bring them to court...

THe answer to your question is yes. The defendant needs to respond to your complaint or you can take a default.

Of course the Plaintiff needs to respond as you have filed a suit against them. If they do not properly respond, then you can move for default.

If you can get her to state on the record that she will appear pursuant to the subpoena then you will not have to re-serve her. Otherwise, you will.
