Paid $3,500. Received no work product. Retainer not refunded.

I hired Marc Hankin in August 2025 for a very specific task: to review and revise a settlement draft in an active federal litigation matter. I paid a $3,500 advance deposit with the understanding — written in email — that this would cover approximately one hour of review and any additional work relat...ed to the settlement draft. No draft was ever reviewed, and no edits, revisions, or written work product were provided. Despite multiple follow-ups, I never received a single page of deliverable work. Marc later attempted to shift the engagement into a $17,000–$20,000 litigation retainer even though I had never authorized that kind of representation. I declined and retained another attorney. At that point, the original retainer should have been refunded, minus the limited time he actually spent. Instead, Marc claimed he “spent more time than I paid for” but produced no itemized billing and no evidence of any substantive work. There were also no communications with opposing counsel on my behalf and no filings, despite earlier emails implying otherwise. After months of follow-ups requesting the return of the unearned portion of the retainer, I still have not received a refund or an itemized invoice.

Dear Laurent, Your "Review" is incomplete and, well, erroneous. Because you have clearly waived the attorney/client privilege as to the billings on your matter, the truth is that, although initially you had hired me with an Advance Deposit of $3500, you called and emailed me repeatedly and insistently, changing your desired strategy multiple times. I ended up billing you $4,213.50 for the time that you took, and the work that I did trying to resolve your situation, but when I shared that with you on September 4, 2025, I made it clear that I would be writing off the $713.50 that was above the Advance Deposit of $3500 you had paid. I did not hear back from you again for three months until December 3, 2025, when you demanded that I refund to you "the unearned portion of the $3,500 deposit" or else you would report me to the State Bar. I explained to you, once again, that I had performed MORE work than you had paid for, and that there was NO "unearned portion" to return to you. I also explained to you that I was not going to be bullied into returning to you money that I had earned just because you ended up hiring a different attorney who ended up charging you less than the $17,000 I had quoted you for the litigation that you were interested in fighting. There were NO "months of follow-ups requesting the return of the unearned portion" as I did not hear from you for three months after I wrote off your excess work. Perhaps you should revisit your so-called "review" above and correct the facts based upon the email history between us? That would give the public a more accurate view of what really happened here. Unresponsive

Marc was very unresponsive. It was hard to get in touch with him and in the end I feel just took my case to make a few extra bucks because in the end, he really had no clue what he should do to help me. I ended up solving the problem on my own and when I went to be refunded my $1500, he told me he ha...d done enough work to keep it... a few emails and a few phone calls are not enough work for $1500 buddy..
