Yes you can sue them. Then you can face a judge and answer the question as to what harm that has caused you.
The judges in small claims court don't have it out for you. They are just trying to make sure everyone gets a fair trial.

You should certainly try to file the Request for judicial notice before the hearing so the other side has a chance to reply/respond.

Yes you can start an eviction. First you must give them a 3 day notice to cure or quit. If they get rid of the dog within that time, you cant file....
