11350(a) his exposure is 16 months - 36 months in state prision
11351 24 - 48 months in state prison
11377(a) as a felony 16 months to 36 months...

You can but they most likely will not give it to you. The reason being there is a victim involved and they always cite "an on going investigation"...

The judge cannot take away the two charges unless there is a reason (i.e. incorrect pleadings). The DA is the only enitity that can do that once...
