David Evin Isenberg

David Isenberg is of counsel in the Global Corporate Department of Milbank, Tweed, Hadley & McCloy LLP. He has been associated with the Firm since 2001.

Mr. Isenberg specializes in the structuring, documentation and resolution of secured transactions, in each case with respect to both senior and junior secured positions in the capital structure. Mr. Isenberg represents clients on both sides of new financing transactions. Mr. Isenberg has particular experience in the representation of secured creditors in workouts and loan restructurings. He frequently represents secured creditors, agents for syndicated lender groups and bondholders.

His recent representations include advising issuers and investors on:

•the bankruptcy court and out of court restructurings of single asset and multiple property gaming companies
•out of court restructurings of secured credits to industrial companies, including metals recycling companies and agribusinesses
•out of court restructuring of secured credits to off shore resort condominium developers
•state court liquidations of real property collateral owned by a multistate merchant homebuilder
•out of court restructuring of a securitized receivables facility

Mr. Isenberg is the co-author with Gregory A. Bray of “Distressed Debt Investing – Risk Considerations” in The Handbook of Loan Syndications and Trading, Allison Taylor and Alicia Sansone (McGraw Hill 2007). Mr. Isenberg is also a regular contributor to The Journal of Corporate Renewal. Mr. Isenberg is a member of the American Bankruptcy Institute and the Commercial Bankruptcy Committee of the American Bar Association.

Mr. Isenberg received his Bachelor of Arts in Economics from UCLA with honors in 1983 and his J.D. from UCLA School of Law in 1986, where he was Recent Updates Editor on the UCLA Pacific Basin Law Journal.
