My office filed a Writ of Prohibition/Mandate requesting the Appellate Division of the Superior Court to order the trial court to dismiss the case based on the illegal resetting. An Alternative Writ of Mandate was issued, and the trial court granted the defense motion to dismiss per Penal Code 1382, ending the case without any conviction or restitution being paid.
