Jury trial where client was alleged to have violated PC273.5 (Domestic Violence Causing a Traumatic Condition), PC245(a)(1) (Assault with a Deadly Weapon), PC245(a)(1) (Assault with Force Likely to Cau...se Great Bodily Injury), PC236 (False Imprisonment).
Client was alleged to have body slammed his ex-girlfriend on the concrete sidewalk, slamming her head with the lid of his trunk as he closed it, and restraining her movement.
After making the false allegations, the alleged victim wrote a letter to the prosecutor admitting to making a false police report.
We completed jury selection, made opening statements, and began testimony from the alleged victim. It was quickly revealed that she had engaged in numerous felonies leading up and during the alleged incident, including significant damage to client's car.
After a failed attempt at giving the alleged victim an offer of immunity, the case was dismissed pursuant to PC1385 in the interests of justice.
