I completely agree. This is a 'good faith' (inadvertent) error which can be easily explained and adjusted. I don't thihk there is really a problem....

You can have your Attorney file a Motion with the Probate Court to take jurisdiction over the Trust and to legally compel the Trustee to act.

When the Grantor dies, then if you become a beneficiary you have a right to know the contents of the Trust.

Yes you can certainly divide the ownership 50/50 - and you can avoid Probate on it (and thus save $$$) by owning the home inside a Living Trust.
