Kohl's Corporation has agreed to pay a settlement of nearly $1 million in a civil enforcement lawsuit that alleged Kohl's stores were over-charging customers. The civil lawsuit was brought by prosec ... utors from four California counties including the Shasta County District Attorney's Office. In a news release from the Office of the Shasta County District Attorney, prosecutors explained how the case started. Investigators with county agencies, including the Shasta County Department of Weights & Measures, found several cases in which the price charged at the cash register at Kohl's stores was not the lowest advertised or the lowest price. The complaint alleged that Kohl's violated the law by charging customers a higher price than the prices advertised on store shelves and signs. Prosecutors also argued that disclosures relating to the Kohl's Cash program were not adequately made by Kohl's. Without admitting wrongdoing, Kohl's consented to a judgment that includes provisions to ensure future compliance. As part of the judgment Kohl's is also required to pay civil penalties, costs of investigation and restitution totaling $958,686. The settlement money will be split among the D.A.'s offices in Shasta, Santa Cruz, Fresno and Riverside counties and the weights and measurements departments that helped in the investigation. Deputy District Attorney Anand 'Lucky' Jesrani handled the investigation in Shasta County. "Our consumer protection unit pursues these types of cases to ensure customers are charged the correct price, and not unfairly overcharged when they pay at the register," Jesrani said. The terms of the judgment require Kohl's to institute enhanced policies and procedures in its stores to improve pricing accuracy. Kohl's will be required to display signs at the register which explain how Kohl's Cash is applied when combined with other percentage-off discounts.
