Mr. Cook is correct that so long as you don't put him on the title with you nor agree to give him any rights to the title, then you should be fine....

No legal timeframe for the landlord to refund the overpayment. They should credit it towards next month's rent so that you don 't have to pay....

Yes, unfortunately, any claim you might have would be past any SOL.
I have debt on my credit report from breaking a lease. 9000.00 It has been 4 years and I have had no contact with them.

The statute of limitations is 6 years for breach of lease, but even if that was up, it can still be on your credit. If they sue you, they can try...
