Did he come to the US with a visa or without? Nothing is easy these days. Perhaps you can consult with an immigration lawyer in your locality.

If the income is not there, the motion is a waste of money. No, only the person affected or the attorney can submit.

No, as far as I know child support has nothing to do with legal status. I would consult with a family law attorney.
